Portion of property not showing on Title Plan

Hello All, any advice appreciated. I’m going to look at a property today with my daughter, she’s a first time buyer and purchasing on her own so her budget is limited.
The property is a mid terrace, probably around 100 years old, there are lots of this type of housing where we live. The property has an alleyway which leads to a path behind a number of these terraces. It’s used for access to bring wheelie bins out for collection etc. A portion of the house including part of the bedroom and bathroom are above this alleyway. No part of next doors house is located above the alleyway.
Last night I downloaded the registration and title plan for this house from the Land Registry. The alleyway isn’t included within the red boundary lines but neither was the portion of house above the alleyway. I then downloaded the details for next door on the other side of the alleyway and again the alleyway wasn’t included.
I have gone through the wording on the registration and nothing is obvious but I could be just missing something.
I have emailed the Land Registry about this but they’re now not open until Monday and the viewing is today.
Has anyone experienced anything similar or thoughts from anyone would be appreciated.

Is the alleyway in the garden to the property or does it run alongside ?0 -
It’s worth asking during the viewing, but in the meantime have you tried doing a ‘map search’ or ‘detailed enquiry’ on the land registry website? I had a similar problem with the property we’re hoping to buy - the additional land didn’t show up when I ran a basic property search, but it appeared as ‘Land at rear of [address]’ when I ran a detailed enquiry.0

Thanks for your reply. The alleyway runs alongside the property, not in the garden. I have rang the estate agents who will contact the vendor however I believe the property belonged to the vendors relation who has died.0

If the estate agents or the sellers can't help then I'd refer back to the Land Registry. It sounds like the footpath might have it's own Title.0

indeed. If it does appear on a separate Title, buy the Title (£3) and see who owns it. The footpath is usually leasehold as its access for the street to WC back in the days. So it will have its own title.0

There’s a practical solution to this. Has the property changed hands a couple of times in the last 50 years? If so, it’s been looked at by solicitors more than once, and the chances are there’s nothing wrong, so your daughter is not wasting her time. You’d ask your solicitor about this at an early stage, but he’s in a far better position to advise you than anyone here. He may tell you that the house has a flying freehold, which you can google.No reliance should be placed on the above! Absolutely none, do you hear?0 -
