    Hi,

No, they are not asking me to pay any part of the PCN.

Not sure on getting it reduced to £100, i appreciate you thinking of that route though! It's been a huge cloud hanging over me and i just want it resolved so life can go on. I would love nothing more than to get costs etc back but i'm just not in a position to go down that road.

However i really appreciate the help in getting it removed, which is all i want now.

    Thanks.

It makes total sense that the court fee becomes £100 and if you don't ask, you won't get!

May as well press ahead and in your letter to the court changing it to a non-hearing application, also attach the CRA 2015 Schedule 2 and state that the claim had no prospects of success due to the non-prominent parking notices used by this Claimant, breaching the CRA 2015 'grey list' and the claim being exaggerated by false costs that are disallowed under the CPRs, the CRA 2015, the Protection of Freedoms Act 2012, Schedule 4 para 4(5) and with regard to paragraphs 98, 103 and 198 in the Supreme Court decision in ParkingEye v Beavis [2015] UKSC 67. Given that these are case law and statute laws the Claimant had no excuse for an exaggerated claim. There is no need for a hearing in this case, which meets the requirements for a mandatory set aside.

(the reason for the above is to stop the Judge looking at the papers without a hearing, and still not getting it).

Bear in mind nothing stops them restarting the claim - you would possibly still have court - however CEL are knownfor just discontinuing, so I imagine thats what they will do here.

Thanks for the above, like you say, no harm in asking.

So do i need to send anything to CEL? Like a confirmation that it has been sent to court? Do I need them to do anything?

    Thanks again.

You should copy in CEL - see what I just added to my last post when I edited it!
