    9. The Claimant also stated in the Particulars of Claim that the claim is for ‘breaching terms and conditions in operation at the car park/ private land’. However, the claimant has failed to provide evidence of that agreement. Upon recently visiting the parking site, the Defendant noticed that new signage has been put in place. There would be no need to replace signs if they were already adequate.
    You still have that "evidence of that agreement" in there. To what agreement is your defence referring?

    Good about the signage but you will need to remember to refer to it at Witness Statement stage and show "before and after" photos - if you have them.

    Thanks for the feedback i have sent the defence now, so I will have to bear both of these in mind when I put together my witness statement.

    How long do they usually give to complete the DQ and witness staements etc?

    Unfortunately I dont have before photos, only after :(

    When the defence is received by CCBC, they send it to the claimant and they then have 28 days to decide if they are going to pursue the case. At this point, if the answer is YES, the CCBC will send out a DQ. The deadlines will be on the DQ. When the case is allocated to a particular court with a date, the letter will tell you by when you need to supply your WS and evidence. All this of course is contained in the NEWBIE sticky post # 2 "What happens and when".

    You can only file an updated defence upon payment of a fee. I would just make sure your WS expands and backs up your defence.

    i have now received a letter asks if i would like to go through mediation and that is recommended?

    It also mentions a hearing fee of £25 that I need to pay by 25th February?

    Is this correct?

    No to mediation! You want to pay £ZERO they want you to pay £FULL. End of mediation. It is not YOU that has to pay the £25 but the CLAIMANT

    I have started my witness statement but i am really afraid i am going yo tie myself in knots when i get to the court and confuse myself with the main arguments for my situation and confuse all the case laws thar i have to take with my as outlined in the newbie thread.

    I also havent received any SAR information

    Does anyone know if there is a witness statement for a similar sjtuation where a claim was made against someone parking in works car park? I just have a really bad feeling the judge is going to think im so confused and under pressure that ill loose the case
