Ex boyfriend and my house.

My ex boyfriends mum and nan owned the house and both died, me being a fool offered to get a mortgage and my ex boyfriend paid the deposit as a gift (I have this in writing) he also paid the solicitors fees on both sides. The house went into my name just over a year ago. The plan was to do it up and me to move in however after doing one room he still owes me over 1000 for half of things I paid for and the house is an absolute mess he lives like a tramp so No other work has been done as I wasnt spending another penny. He also blackmailed me emotionally into getting a 10 grand loan in my name which he was supposed to pay back straight away. There is just under a year of repayments on that left (he pays this to me a few days before its due into my account each month) he also sends me half of the mortgage each month, we dont have an agreement on this he just does. He also pays all the bills as he won’t give me account numbers still even now, the plan was to pay half of everything and for it to be our home and to settle down and start a family but he has treated me horribly. Mentally and emotionally allowing me to feel worthless since I fell inlove with him straight after we met. The relationship broke down and I never moved in and now That I know I want him out of my life I need advice on my rights and his. He keeps saying he will get a solicitor and do a deal however he would never ever be able to get a mortgage on his own. He believes I owe him the deposit, the fees he paid and thousands that he had to pay to his late mum and nans mortgage company. The house is in my name fully, there is a copy somewhere of him signing to say deposit was a gift. How can I get him out of the house? He can be very nasty when he wants to be, threatening me financially and he has always been an emotional abuser to get what he thinks he deserves. I’m only looking for advice, it’s taken me 3 and a half years of being treated like a mug by this guy to get the strength I need to get rid of him finally so please don’t judge as I’ve been through hell and back already. Any advice would be so appreciated. Thankyou.

    Realistically the deposit is his, you know that. Sell the house, give him his deposit back and move on.
  • Sometimes its best to just draw a line under these things and move on?
  • It would certainly be reasonable to return the deposit and fees.

    I'm not sure what you mean by 'the thousands he paid to his mum's mortgage company'.

    As well as the relationship life-lesson here, can I suggest another? When writing (amost anything, but especially if seeking help from strangers!), make it easy to read!

    So the propety is in your sole name, as is the mortgage yes?

    You have been accepting this money. Therefore he has been paying you rent.
    You are a landlord. Have you been declaring that income to HMRC?
    Have you complied with all the other legal obligations of a landlord (see link below)?

    He is a tenant. He has tenancy rights.
    You are his landlord. You can evict him by following the correct procedure. See below.

    a deal? Either you evict him or you sell to him.

    Well he paid it did he not? So morally yes.
    Whether it was legally a gift to you, or a loan, is unclear.

    * Ending/renewing an AST: what happens when a fixed term ends? How can a LL or tenant end a tenancy? What is a periodic tenancy?

    There is no written tenancy agreement, but he pays you rent monthly. So he has a monthly contractual periodic tenancy. This can be ended by serving a valid S21 Notice (with 2 months notice) and applying to court when it expires.

    Unfortunately, to be valid, you must have done a number of things, which I suspect you have not eg give him
    * an EPC
    * gas report
    * gov leaflet

    You need to start behaving like grownups.

    He is a tenant, so has tenant rights...

    BUT... you have the upper hand as he paid the deposit as a gift.

    I suggest you TELL him that the house is going to be sold, so if he moves out NOW you will return his deposit, but if he opposes the sale, you will sell it with him as a tenant, and the decrease in price will mean his deposit is gone.

    Was the house left to your ex in the mum/nans will?

    Why did the house go in your name only if the plan was to live there together and eventually start a family?

    Why haven't you been living there all this time?

    Its not about the money it’s about getting him out of the house and out of my life, thanks for your reply
