Item Faulty

Options
Hi,

I ordered a bag from Michael Kors in the sale for £180, a few months later bag is broken. They have advised me to send it back as covered by warranty. My issue is once sent back they only issue a refund, Bag now is back to £360. They cant issue replacement they only refund. I can't get a bag similar on their site for the price I paid so am now losing out as original was faulty. Is there anything I can do or do I just have to take refund and be left with no bag?

It's their warranty so they can choose the remedy. You have no entitlement to a replacement unless they offer it.

They can't leave you worse off and in this case, they wouldn't be doing so.

I'm sure they will be having another sale at some point over Black Friday, Xmas, or January so there is a good chance you will be able to get a replacement.

Pop into one of their outlet stores. They always have bags discounted.

You can request a repair or replacement, but really it's pointless because:
    1) The retailer can refuse to replace if its disproportionately costly in comparison to a repair (or impossible) and,
    2) If they fail to provide a replacement or repair, your remedy then is for a refund or reduction in price - which is what you're trying to avoid.

Unfortunately its one of the pitfalls of bargain buys.
