Unknown Wages Over Payment, Taking In Full

  • A couple of updates.

    I have spoken to my Direct Manager who has been provided some information. As they pay company sick in arrears, I received my normal wages in August as my salary, and as such the company sick pay was only visible on my wage slips from Septembers pay.
    There has been an error where this wasnt seen and have been overpaid company sick pay for a couple of weeks. Thus being the reason for having no wage this month as they are collecting it back in full, in line with the law, if I have an issue with this process I have to contact ACAS , who will confirm they are staying with in the law.

    I have made contact with my solicitor, who had apologised that he cant give too much information as thos isnt his field of law.
    He has informed me that he can look into the possibility of an interim payment. However to do this he needs the medical report off there specialist doctor. I have had my medical with them (Wednesday 27th November) who said she will have the report over to my solicitor within 1-2 weeks. So there could be some form of financial light coming soon. He has already got my wage slips to assess the interim payment.

    In regards to Industrial Injuries Disablement Benefit, I will certainly have a look into this. I know I have not been diagnosed with any disibilty. My injuries have improved, and now have 60 - 70 % movement in my spine (was at 50%) so not sure if this classes as a disibilty.

    Does this mean that you've been overpaid only for two weeks, they've recovered it in full this month, and that your sick pay will return to normal next month? If so, that's not as bad as you feared.


    If you're strapped for cash, I'd try to get some sort of interim payment or advance on December's pay. You could try to get your solicitor to assist you, but I'd try it myself or ask my manager to request it. Point out you've received zero pay this month because of the un-notified recovery of the overpayment (which was through no fault of your own and which you were unaware of) and you want to request an advance on December's sick pay as you have no other income. Obviously the advance will need to be recovered, but it seems better than nothing.

  • Good Afternoon

    I have received an email resolution to everything.

    I have been informed I have 6 days of holidays left, which run out at the end of the year. They have said they will allow me to be paid my holiday pay to offset the majority of what is left owing from the over payment. This will leave me owing £84.

    They have said they will pay me my full SSP in december, and leave the final £84 until I return to work.

    At least I know I will receive my SSP in full next month so all isnt too bad.
