My solicitor did state that to me that either way the wages would get paid.
I presume they would rather take the awkward route and make things even more difficult for me.
Hopefully they have a quick response in showing a break down and proof of where exactly i have been over paid.

Also in regards to the Union, I am not clued up on this what so ever, but i know we dont have a union at our work. Not sure if theres a union i could of used elsewhere?
My place of work seems to be lacking on a lot of areas, I mean supervisors, team leaders and even the whole of management didnt even know where the accident book was kept. I had to just write what had happened down on a blank peice of paper. We also have 30+ first aid workers and wasnt offered any assistance.0 -

Thank you very much. I think I will definitely have to look at joining a Union, I imagine my life will be made hell when I return to my work place. And most likely look at any tiny fault to catch me on.
I know one poster mentioned about maybe they was looking at balancing the books. I know full well the issue is nothing to do with a financial gain, and im positive its just to be hardwork towards me. They are a mega multi million pound and boast HUGE profits every single year. Our sub company alone has a bonus pot of £250,000 set aside each year taken from there profits.0 -

No-where 'has' a union. You can join any union you like.0 -
I've probably got this wrong (apologies if I have but my only experience is of Occ sick pay) but is the employer entitled to stop SSP to recover an overpayment? I thought they claimed SSP back so it shouldn't have any relevance to an overpayment recovery.
OP - are you confident you have not been overpaid? You say you've been through your payslips together with your manager and he can see nothing wrong. Also the pay going into your account tallies with what's on your payslips.
It's not clear to me whether you or your manager has asked for the breakdown of the overpayment. If you're on good terms with your manager I'd get him to chase it up*.
If you are already claiming from your employer in respect of the accident at work, it might be worthwhile exploring whether your solicitor can contact your employer pointing out that their actions in recovering any potential overpayment without giving you any notice of such recovery (is that what's happened?) has left you with zero income. That their action will only increase your costs and that their failure to provide a breakdown in a timely fashion will be seen as unreasonable.
I'm not sure that there's any downside to that approach, but I think it is worth highlighting at this point that they are being unreasonable (irrespective of whether being unreasonable is unlawful).
* It sounds like you're dealing at third hand with an outsourced payroll provider. I've dealt second hand with a payroll provider and it can be difficult. I shouldn't be at all surprised it it's a communication problem or a simple cockup. If you can get your manager involved, try to make sure he's dealing with the right people regarding payroll queries. There should be a clearly defined procedure for dealing with such queries, but in my experience, managers aren't always aware of them. Don't just assume your manager knows what they are doing.0 -
Really do think there needs to be a bigger promotion of unions - lots of people seem to think they can only join one if the organisation recognises one rather that its there to help the individual in circumstances like this. Even though I'm an experienced HR practitioner I am still in a union, if only for their employment solicitors if I need them.0

In regards to the taking of full payment from my SSP, from what I have read is that it is common practice to await my return to work to set up some form of payment plan from my wages. (If in fact I have been overpaid I would of course pay it back) Im the kind of person who has rang the tax office up when i hadnt been taxed.
I am 100% confident I havent been overpaid. I have checked back through all my wage slips and they all correctly match what was paid into my bank account. No extras have been added on to my wage slip.
I got onto my manager again this morning to request a breakdown and show proof of where exactly this over payment has come from. He said he would get right on it and hopes to get these break downs today.
I will certainly see if my solicitor has any options available for me, obviously having 3 young children to provide for and general bills, money is always tight anyway. But now with receiving £0.00 this payday and being told my december payday will also be £0.00. This is obviously an horrendous situation to be in. Wondering where rent and food and all the other things arr going to come from. Obviously christmas isnt a priority but thats well and truly ruined.

You're payroll is outsourced to a different country? (So was ours but that was "only" Scotland!).
Out of curiosity, can you give an indication where? I can understand you may be reluctant to say if you're in dispute with your employer.
It's bad enough dealing with an English speaking payroll, I can imagine all sorts of problems and delays - unless it's somewhere like Eire, or Jersey or the Isle of Man, or the Cayman Islands!0 -
I honestly dont know where the wages department is located. Myself and other workers have never had any direct contact with them. Alls I know is from an experience last year when there had been an error with my wages and was massively underpaid, my manager did all the chasing with head office, it was my manager that informed me that the payroll is situated in another country , and the accounts are dealt with in offshore accounts.
So could basically be anywhere. And my employers are always very reluctant to provide any information0
