Inheritance

mother in law recently passed away, father in law already deceased.
My husband is also sadly deceased. Should his (our) children inherit what would have been his share of the estate along with his siblings? there was no will left. Thanks

    Yes. The children will inherit his share and it should be divided equally between them.
  • Thats what i thought but I dont think they see it like that....
    If they do everything legally as they should,how long should it be left until questions are asked?

    One option might be to offer help, if you're able, rather than diving in with questions.

    Don't start a war too soon, try an amicable discussion first with one or two of the family if you can. When you've answered Robin9's questions #5, that person/those people, may plan to incorrectly distribute the assets but then be held personally liable, so they need to understand that.
    Seen it all, done it all, can't remember most of it.
  • I dont know whos doing what, if anything. They may have just divided any monies between themselves. Sadly, after my husband died we were not really considered part of the family anymore.

    Have you asked them? Have you spoken to them at all?

    Asking them how it's progressing and when your children can expect their share might be a good way to break the ice, if you haven't done so already.

    If they're not cooperative you really need to get yourself a solicitor. It's likely to get messy.

    They will have to apply for Grant of Administration and this will require them to list all blood relatives.


    Contact them and ask who is dealing with the estate and check that they include your children.


    I am in the process of dealing with my Brothers estate under similar circumstances.

    To be honest I thought this was rather obvious. I am sure someone will correct me if I am wrong, but we are talking about the deceased husband's siblings.
