Can I ask for advice and sorry for the long post as I wanted to include all details
On Saturday I bought an APPLE 10.5" iPad Pro - 256 GB, Silver (2017) from Curry’s in their eBay shop. Cost £449. The item was been sold as new. The item was paid for via my eBay account and I received this email from eBay ‘You sent a payment of £449.00 GBP to DSG Retail Limited.’
I then received another email stating Thanks for making another purchase Kevin. Your Oder is confirmed.’ That was yesterday at 11.11
I then received this email at 10.34 this morning. It came from ‘Your.Order@teamknowhow.com’

Again please accept our apology for any inconvenience this has caused.
We are looking forward to hearing from you.’
I’m sure this is not uncommon occurrence but as a customer who, I recon, has paid for an article and they appear to have accepted the payment. Where do I stand. Can I insist in them fulfilling the order or is it a matter of grinding and bear it !
Can you offer advice on what to do next
Many thanks
Kevin

You can do nothing - they are putting you back in the state you were prior to order and they are covered in the T&C's you were advised to read by them in this paragraph:We take all reasonable steps to ensure all details, descriptions and prices of products and services are correct at the time the information was entered onto the system. Sometimes we have to hold our hands up and admit we have made a mistake by unintentionally publishing inaccurate information on the site (e.g. the price, description or availability of a product you have ordered). In this instance we may have to cancel your order at any time, even if you have received your Order Confirmation email, and you will receive a full refund of any charges already paid.0

If they have no stock how would they realistically fulfil ill the order? Generally until dispatch no contract has been formed but check their t&c’s. Take the refund,0

Take the refund and buy it elsewhere.

Thanks for responding so quickly, I thought that’s how it might be.
As an aside it’s a popular iPad and I would imagine they will have it back in stock.
But as you said you can insist you want !0
