Solicitor closed down for dishonesty, joint executor

Hi, I'm joint executor with a solicitor in respect of my late Uncle. Solicitor has been closed down for suspected dishonesty. At present his whereabouts are unknown. Probate has been granted and the bank has closed down my Uncle's account and the money (6 figure sum) sent to the Solicitor, 3 weeks before his practice closed. Can I remove him as an executor? An intervention practice is now holding the files but won't release to me without the other executor's consent. Any advice gratefully received, thanks.

Comments

  • Tricky, yes you can get him removed but it would have to be done through the courts.

It might be worth calling the Solicitors Regulation Authority on Monday for advise 0370 606 2555. They would be the people who struck your solicitor off.
