Bought a car without knowing it was under finance

  • Yes you are probably right there; the 'finance' company do not seem too proactive about seizing the car which is a good sign. Still leaves the OP stuck with it until they decide to write off the finance, or not.
  • Thankfully the finance was taken out through a bank which is why I think they are just sending forms out and don't seem interested in taking the car. I just don't understand why someone would think it's okay to sell a car that they have finance on - it's not right.

    As for not too bothered about taking it back, legally they can't, if they legally could repossess it, they would. They aren't being kind,just lawful!
  • Update on the situation. We phoned the finance company multiple times and were told that the questionnaire was going to be sent out - it never was. On the last phone call we made to them, the person explained that the questionnaire still hasn't been sent, put us on hold to speak to the manager and came back 5 minutes later to tell us that their interest in the car would be lifted within 48 hours. 48 hours later I did an HPI check and there was no longer any finance outstanding on the car. Problem solved! We still have no idea why they lifted their interest in the car without sending us the questionnaire etc but I'm just happy it was all sorted!

    They lifted their interest because they pretty much had to. You were an innocent purchaser so had good title.

    Maybe they realised they made a mistake and the previous owner had paid it off.
