Statutory nuisance action against the council

I live in a multi-flat house and for a couple of months now I suffer the water leaks from the flat above. The flat above is leased by the council, whereas I am a tenant renting from a private
landlord. My landlord (and myself) complained to the council about the leak umpteen times, but they claim they are not able to fix the water leak.

The leaks are quite disruptive and I am considering taking legal action. Is it possible to start a private statutory nuisance action (EPA sec. 82) against a council (/mayor of the council) as opposed to a person as an owner of a building in disrepair?

Have you contacted the freeholder or block management co?

I don't understand, the council is an owner of the building. My landlord is a freeholder of one flat.

You can sue any sort of incorporated body, in addition to individuals. That includes a local council. Make sure you send the paperwork to the council's head office.
