Hire Van Accident & Additional Charges

Hello all,

Looking for some advice on some additional fees I have just been charged after an accident in a hired van:

Not disputing liability as it was my fault. I had the excess insurance and on returning the van was told I wouldn't need to pay anything else as I was covered. Just had an e-mail from the Hire Company telling me they they have charged me another £250 for the vehicle being unable to be used whilst it's repaired. This type of additional charge is in their T&C's buried on the website, but they did not make me aware of it when I signed the paperwork, nor is it on any of the paperwork I have signed.

Any thoughts on if they are just 'trying it on' or if it is a legitimate charge? If it is a legitimate charge I will happily pay it.

    Did you enter into the contract online? If not then you can't be bound by terms you had no chance to become acquainted with before entering. However, there may be another clause in the terms you were given that enable them to recover the fee.

    Does it say anything about losses or damages?

    If you signed a physical contract, then the contract and any paperwork that came with it is the contract.


    They can't then point to some web site that adds other charges that you never agreed to.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.
  • Thank everyone so far... They have changed tack and insist it was on the rental agreement I signed, which seems odd as my copy doesn't have it on, nor does the copy they sent me as proof! I have told them if they charge my card without my permission I will instruct my CC company to claim it back. They have now gone quiet.

    If they do charge you I personally think they have missold the excess insurance and I certainly would not pay without a big noisy fight
    If they are members of BVLRA then perhaps try the resolution service
  • Still no response, but they decided to charge my card without my permission so I have flagged it with my card company and started a charge back.
