In respect of the question asked .... I notice it says "Company Let Tenancy Fee" - is this flat being targeted at companies looking for accommodation for employees/visitors/clients? If yes then the legislation may not apply.1

The contract is detailed as a standard AST. I'd assume a company let would be more flexible. Either this is an agent trying a loophole or it's a copy of a pre-legislation listing. Were it truly a company let, that would be in the main listing. I've a feeling that if my son challenged them on it, he'd be blown out. All a far cry from when I last rented a flat around 2000 when the there was no fee to me apart from a minor one for referencing.
