Cash generator

HI
I put down a deposit last month (£30) on a musical instrument for xmas present. I went in today to pay remainder but the price has dropped from £179.99 to £125.99. CG staff said if I were to buy the instrument at £125.99 I would forfeit my £30 deposit.
I cannot see anything on Cash Generators website that covers this issues - does anyone know what my rights would be in relation to deposit?

  • IANAL but I suppose they would argue that a contract was formed at the original price and for which you paid a deposit. It's your choice to continue and fulfil that contract or back out and lose the £30. In the latter scenario you'd still be £24 better off than you were originally.

I suspect that's what they've tried to do and can only do so by forfeiting their deposit.

When you secure an item by paying a deposit at Cash Converters, something they call "layby" or "Spread the cost", they are supposed to remove it from sale as it's considered sold.

You enter into an agreement to pay for the item, based on payments you can afford.

As long as you keep up with the payments, when it is fully paid for, it's yours :)

So the store cannot re- or continue to offer it for sale unless you have broken the terms of your contract.

Can you not send a friend in to buy it? Then try and collect what youve put the deposit on which theyre unable to supply and thus return deposit.
