  • I called them but they’d already applied for the direct debit. But it’s not relevant is it? It didn’t happen so there’s no point in wishing for things that I can’t change. I’m really just trying to find out what can be changed going forward.

    The only way forward that I can see is to investigate the causal relationship between the overdraft charges and the resulting default of the account.

    The only way that I can possibly see this happening would be if you could provide evidence that the default was directly caused by 'unfair' charges.

    Perhaps you’re not reading the earlier posts. I did contact the bank. They put me on a repayment plan that I couldn’t afford. They knew I couldn’t afford it based on the budget I submitted to them. I paid the debt down to the amount I could afford every month but as I couldn’t meet the repayment plan I defaulted.

    But I’m telling you they did. I had an entire conversation with a lady at NatWest about the fact that it was not affordable and she told me the amount of my offer of repayment was ‘unacceptable’ (or however she termed it). Again, I have no reason to fabricate this. NatWest will have records of this call no doubt and I have an email trail with the detailed budget that I sent them. I’m not sure how I’m able to ‘renegotiate a payment plan’ when they knew my circumstances and said no.

    Could I please ask why you didn't call the electricity company and negotiate a payment plan with them before the direct debit was taken in the first place?
    Have you ever asked Natwest why they paid a direct debit which would take you several hundred pounds into unauthorised overdraft? It really is highly unusual in the case of a low income individual with a minimal overdraft facility

    By the time I realised the amount I called the electricity company. Yes I should have checked the bill sooner and I wish I had in hindsight. They told me that the direct debit was already applied for. In fairness they were very helpful in reducing my bill going forward to an affordable amount until I was well again or I’d have been in a real financial state. They did say that if the funds weren’t there then the DD would return unpaid and we could work out the repayment of that debt over the year.

    But it wasn’t returned unpaid. I agree.... It’s highly unusual. I’ve had much lower amounts bounced in the past when I was earning much more so I don’t know why this wasn’t. When called NatWest they said that they can honour DD at their discretion but they wouldn’t give me a proper answer on what criteria that was based on. That’s the thing. The amount of the bill I had racked up was insane and any reasonable person looking at that would have bounced it. But as another post pointed out, it’s in the T&C’s that they can do what they like when it comes to bouncing payments. So, it was honoured.
