Letter Before Claim - NPE

Hello. Let me start buy saying what a wonderful resource you all supply and thanks all those who help and support people on this forum.

I have received a Letter Before Claim (LBC) from NPE in relation to an overstay of just a few minutes last year. As I suffer from depression and anxiety I have tried to ignore the barrage of threats and bullying from this company to this date but realise after reading the newbies thread that I must now take action.

I have started to compose the SAR as linked in the newbies post but there are a couple of points that I am unsure of and I wondered if somebody can help.

Firstly, the letter is not from Gladstones solicitors, it is headed with NPE Ltd and one of the similar threads I found stated this may not be the same thing so some clarification on that front would be great.

Secondly, included in the letter are forms requesting financial status etc and it states that reply must be made within 30 day of the date shown at the top of the letter however there is no date on the letter received which is strange.

Anyway, I can post images of the letter is required (obviously excluding personal data) and I will post the SAR letter which I'm still trying to understand as I write this.

    If it contains financial information forms and gives 30 days to reply then it is indeed a genuine letter before claim.

  • Thanks again. Here is what I have gleaned from the newbies thread. I have not included my name, address and telephone number or the address of the recipient in this post but they will be included in the email.

    Should I include any of the claim account information in this?


    Subject access request ( Data Protection Act 2018 / General Data Protection Regulations (GDPR) )

    Dear Sir or Madam

    Please supply any data about me that I am entitled to under data protection law relating to myself. My name and address are shown above.

 Please include the following…

    - ALL photos taken
    - All letters/emails sent and received
    - A PDT machine record from that day of payments made.
    - All data held including all evidence and a full copy of the PCN, NTK
    - A list of all PCNs against me. 

Please note that any claim must be for all PCNs in one claim, not several separate claims.

    If you need any more data from me to confirm my identity please let me know as soon as possible. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month.
    If you do not normally deal with these requests, please pass this letter to your Data Protection Officer, or relevant staff member. If you need advice on dealing with this request, the Information Commissioner’s Office can assist you. Its website is ico.org.uk or it can be contacted on 0303 123 1113.

    Include a sentence something like "I enclose a copy of my vehicle's Registration Document (V5c) to confirm my entitlement to this data".

    I doubt it's a genuine LBC.

    Surely it's just the usual letter impersonating a LBC, enclosing the PAP reply forms to frighten you, but actually asking for payment to CIS (a debt collector who can't sue)?

    As per the half a dozen other CIS NPE threads (search the forum).

  • Thank you. I have not mentioned my car registration as part of the SAR so far, I'm guessing if I'm going to include a V5 then I should do so?

    Not really; if you use their PCN ref and their LBA ref, then that will flag your VRM to them.

    Answer the question asked, please.

    Okay. Yes I did read about some LBC's not being genuine hence why I asked in the original post (please see above). I will upload a photo of the letter once I figure out how to upload it but it certainly does include a note saying queries or proposals must be made to CIS.

    No need, if it asks for payment to CIS then it's the same as the other threads and is not a real one. But do send NPE a SAR.
