[FONT=&quot]Hi all, firstly let me just thank all the contributors to this forum, your time and efforts are hugely appreciated by those of us new to these waters.[/FONT]

[FONT=&quot]I thought I would document my current proceedings in the hopes that I can get some clarification on a few points, further advice, and it may help others down the line.[/FONT]

[FONT=&quot]Last month I received a PCN through the post from Premier Park Ltd with some pictures of my car in a local retail car park. The charge was Parking and Leaving Site with the amount due of £100 with a discounted £60 acceptable if paid within 14 days (aren’t they nice!?).[/FONT]

[FONT=&quot]I went on to PP’s site and using my referenced number I accessed my case which included several additional photo’s of my car, some close ups of the parking signage and a nice shot of the inside of my car through the window which captured a lovely reflection of the individual taking the picture. Clearly seen is a Body Warn Camera strapped to their chest but I note none of its footage is available at this point. Perhaps it’s not admissible?[/FONT]

[FONT=&quot]What is not shown is any imagery of the supposed driver either leaving or approaching the vehicle, or indeed the site.[/FONT]

[FONT=&quot]After reading through the fantastic NEWBIE thread here I have decided to appeal this. In my mind the appeal is based on the following, I’m not sure however how relevant this information is.[/FONT]

  • [FONT=&quot]No proof of driver leaving site or having not visited any establishment within site.[/FONT]
  • [FONT=&quot]Signage clearly displays Maximum Stay of 2 hours, No return within 1 hour. All other information is very small including any charges that may be incurred. This is proven by their own images.[/FONT]
  • I[FONT=&quot]n particular, quoting from this forum’s section on Signage “[/FONT]the minuscule font size of the £sum… is NOT sufficient to bring the parking charge (i.e. the sum itself) to the attention of the motorist.”
  • [FONT=&quot]If any CCTV footage from the BWC is available, it has not been made available. Relevant?[/FONT]

[FONT=&quot]I submitted my appeal using the BPA/IPC members template.[/FONT]

[FONT=&quot]A little over a week later I got an email from their NOREPLY account with content that I’m sure is familiar to many on here:[/FONT]

We note your comments and must refer you to the Protection of Freedoms Act (PoFA) 2012, Schedule 4 - Recovery of unpaid Parking Charges. This is available to view online at: (website)
We must therefore request that the details of the driver of the vehicle at the time of the contravention are supplied…. Blah blah blah
This did not include a POPLA code. I expect that will follow after their deadline to the above request which is the end of this week.

[FONT=&quot]During this whole process I’ve been doing a lot of traveling between England & N Ireland due to my father first being critically ill in Hospital for over a week before finally passing away. He was a stubborn !!!!!! and this fight is the kind of situation he relished so in his spirit I’m not standing for these cowboys’ crap![/FONT]

[FONT=&quot]I know it's early yet but I'd appreciate any thoughts/comments on current progress along with any advice. One other point was a complaint to local MP, but with elections happening I feel this may have fallen on deaf ears as we technically don't have local MP's right now do we?[/FONT]
