Second hand phone faulty, Cash Converters warranty

I bought a second hand phone from Cash Converters and it is giving me problems. It turns off even though the screen says there's plenty of battery left, if I charge it whilst the phone is off wait until it reports 100% and then turn the phone back on it will report the battery as having any random percentage from 4% to 80%.

Cash Converters claim to have tested the battery and found it to be fine but also say that the battery isn't covered under their warranty anyway. Now I'm not a phone repairer, I don't know if this is a battery problem or some other hardware issue. The battery isn't user replaceable and if they tested the battery like they claim, then the cause could be some other faulty hardware such as a sensor inside the phone.

What sort of rights do I have with this as they seem pretty adamant that the battery isn't covered? I know phones with removable batteries wouldn't be covered by anyone's warranty, but since the phone battery can't be removed does that change my consumer rights?

  • It does sound like a battery problem. How long ago did you buy the 'phone?
  • Just over a week ago, I notified them the same day but had to nag them to even get a reply, they've really been dragging their heels!
  • If you bought the phone just a week ago and it's obviously faulty you are entitled to a refund. The problem is they deny any fault.

    If you only bought it a week ago I wouldn't have thought it's a warranty question. Is it faulty? Sounds like a yes to me. Does it do what you'd reasonably expect a mobile 'phone to do? Sounds like a no. I think you need to reject it. Other posters may agree and other posters may disagree, saying it's not a fault.


    Was the price you paid reasonable for a fully working and batteried phone, and not some ludicrously low knock-down price?

    Apparently the battery itself isn't warrantied as its a "consumable" item - If it was a removable battery then fair enough but nearly all phones today have non-user replaceable batteries! When I think of something as "consumable" I expect it to be relatively easy to replace! I raised the issue with them the day I got the phone but it took them 10 days to reply (and that reply only came because I got in touch with their complaints department at head office!)

    In the reply I got they claim to have "tested" the battery and it was fine. My argument to them is if the battery is fine but it is still facing issues, then it must be a hardware fault. No doubt I'm going to have to wait another 10 days for them to get back to me.

    No, it wasn't a particularly low price, about the same as everywhere else. It was also listed on their website as being in perfect working order. I can totally understand that the battery capacity of a used phone might not last as long as a new phone, but to go from 100% to switching itself off in as little as 20 minutes of use? I'd definitely say it isn't fit for purpose
