Worcester Bosch Boiler cancel

I’m in need of some advice...
Our boiler has stopped working so we have no heating or hot water. We had an engineer out on Tuesday night, 12/11/2019, and he advised we would need a new boiler. We paid him £200 deposit and he ordered the boiler from Worcester Bosch on Wednesday 13/11/2019. The quote was £2500.
We found out tonight we can’t borrow the money so called the engineer and he advised the following:
‘Unfortunately I’ve ordered the boiler and can’t cancel it. Worcester Bosch have had so many people order boilers, which they then deliver to your nearest location, only for customers to cancel and they are left with too many boilers in different locations.’ He said he can’t cancel the order now and as the boiler is £1900 we still owe him £1700. Is this correct?
We simply do not have the money and cannot afford this. I would have thought there would have been a 14 day cooling off period???
Any info/advise would be greatly received. Thank you

  • What he is telling you about WB is pure BS, which should ring alarm bells about the need for a new boiler in the first place.

    Absolutely but that still doesn't get the OP off the hook for new boiler now that they've agreed to get one ordered and installed, not unless he can prove that they've been missold.

    Unless you agreed the contract at the plumber's own premises, you have a 14 day right to cancel. They should have given you written notice to that effect, and a cancellation form to fill in if you want to cancel.


    You are entitled to your deposit back, as well.

    I got the impression that the OP had the plumber out then agreed to the new boiler the following day -

    "We had an engineer out on Tuesday night, 12/11/2019, and he advised we would need a new boiler. We paid him £200 deposit and he ordered the boiler from Worcester Bosch on Wednesday 13/11/2019."

    If that was the case then this can't be classed as an off premises contract.

    But how would the plumber order a boiler from WB on Tuesday night? Surely he would have had to wait until Wednesday morning (at least) to do so? (That's how I read it ... OP agreed to the order on the Tuesday evening, and the plumber placed the order on the Wednesday).

    As such the contract as described is no different to a windows salesperson coming out and arranging an order for new windows. Would you also say a customer couldn't cancel an order after an evening visit from a window salesperson?

  • It’s possible he ordered the boiler online, so it has indeed been ordered.
    I don’t believe you have the right to cancel, unfortunately you should have checked your ability to pay before placing the order. Personal loan is probably your best bet

    Like I said, I read it, possibly mistakenly, as the OP got a quote Tuesday evening, then gave the go ahead on Wednesday. Clearly if that's not the case then fair enough and CCRs apply.
