Re-Selling Wax Burners from Supermarkets

Hello all,

I have a quick question with regards to re-selling from supermarkets as a small business.

If I wanted to buy say, 10 Tea Light Wax/Oil Burners from a supermarket such as Asda or Tesco, would I be able to re-sell these for a higher price in a gift set with my own handmade wax melts?

I understand some businesses and corner shops buy products from supermarkets to then sell on. I worked in a nightclub a few years ago where they would buy all their alcohol from Tesco, as it was cheaper than a wholesaler when on offer. Tesco seemed fine with this.

I'm just wondering if I can legally buy and sell these wax burners for a higher price as a gift set with my own wax melts included? How would you know if the design was trademarked to that particular store or if they got it from a wholesaler in china themselves.

Any help would be much appreciated. :)

  • Don't forget that buying and then reselling would make you a business and with being a business you will have far more legal obligations compared to a private seller.

    If selling online then you have to make sure that you comply with all of your obligations regarding distance selling, but more importantly, you would have to ensure that what you are selling is safe and that they meet any required standards.
    If they don't and one of your wax melts causes injury or damage, you could find yourself liable for an awful lot of money.

    Yes I have all the correct insurance and policy cover for being a small business and selling online/in person. I'm just wondering if I can legally buy and re-sell items from a supermarket, if that item has been made for that particular supermarket.

    Own brand stuff then the supermarket will hold the rights .

    But that doesn't really mean anything. There's nothing to stop somebody buying something, and then selling it on to someone else.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    Once they have sold the candles to me they no longer belong to the supermarket, they belong to me and I am free to dispose of them any way I wish.

    Check the terms of your public liability insurance.
    Cheap tea lights are noted to often suddenly flare up with a flame about 1 foot high.
