Get a written statement from the council of all the payments they have made, with amounts and dates.

That will either confirm or contradict the HA's claim.

If it contradicts, then make a copy (keep the original) and send/take it to the HA showing the payments they claim are missing.

With the (original) statement in hand, if it ever goes to court, make every effort to attend the hearing. Put the statement in front of a judge, and he will have the discretion to throw the case out and instruct Genesis to correct their records. Just because notice has been served, they are a long way from throwing you out of your home.
Any language construct that forces such insanity in this case should be abandoned without regrets. –

Treasure the moments that you have. Savour them for as long as you can for they will never come back again.
  • Was an a actual notice served with the email. The email you have received is not a formal notice. When did you get the formal notice itself?
  • If discussing rent arrears over the phone, follow up witb an e-mail. If you don't already have them, ask Genesis for rent statements from when the arrears began. You will then be able to see if the arrears grew slowly or if payments are missing. How much is your weekly rent and how much housing benefit do you get? How many bedrooms do you have and how many people in the property? You should have award letters. Ask Genesis which payments are missing as they should be able to identify the periods. Sometimes housing benefits end up on someone elses account or in a suspended account. It is surprising it's been allowed to go on for 2 years. You'll need to know which payments are missing and then the council can confirm they made the payments. In the meantime accept the support they are offering and chances are the Support worker can help locate the missing payments.
  • Hey all. just an update i have done everything you guys have suggested and currently waiting for people to get back to me, Chris Brown has not yet contacted me so hopefully i will get a response sometime soon, i am doing all communications with genesis via email so that i can keep a record, since previously all talks have lead to loose ends.

When i have a final outcome i'll let you know what went wrong and how the situation unfolded, thank you
