Argos - Returned item no refund

Just looking some advice on what to do next.

Bought a pram from Argos with an Argos card in Jan, baby born late August. Pram had a fault and contacted Argos at the end of September. Argos agreed to a replacement. As this is a drop ship item they gave my details to the manufacturer who contacted me directly. The manufacturer sent a replacement seat which didn't rectify the fault, they then sent a new frame in the wrong colour and it had the same fault. I contacted the manufacturer to advise I wanted a refund. They said that was fine and would confirm with Argos. A week passed and they stopped replying to my emails and wouldn't answer my calls. Contacted Argos who advised they would get manufacturer to arrange collection. Both prams collected 2.5wks ago and I've been on the phone to Argos every other day, they can't get in contact with the manufacturer to confirm they received the pram so won't refund, despite me having a collection receipt from the courier.

I sent a letter in writing to Argos head office which was signed for on Monday but no response. If I'd have paid via credit card I could have went to the card company but as it was an Argos card I don't think I'll get anywhere.

It's been a whole headache and Argos don't seem to care that my contract is with them not the manufacturer. I now have no pram and no refund. What is the next step? Is it small claims court? What is this likely to cost me?

    It's not up to the manufacturer to tell Argos to make a refund....Argos are under no obligation to do so.

    And are you really expecting a response from Argos todsy for a letter they received on Monday?
  • So how do I get my money back if Argos are under no obligation. I paid Argos, Argos told me to return to manufacturer which I've done and they're under no obligation to give me my money back?

    Well, yes it's an item I can't do without and I left my contact number.

    It's not clear from your post the exact timescale but if it was more than 6 months from date of purchase then onus is on you to show that the fault existed when you bought the goods. You may have already done this but Argos can choose the remedy....replace, repair or refund. Any refund can be a partial refund to reflect the time the product was owned.
  • I see, obviously the item wasn't used until after the baby was born. They did replace but same issue which is why I've requested a refund.

  • If you need a pram the first thing I'd do is buy one. The refund will get sorted in due course but there's no point incurring further inconvenience whilst you wait.
