Euro Carparks PCN

Hi and thanks in advance

received a ANPR PCN from Euro car parks few weeks ago, appealed via their appeal page as recommended by this forum.
it was rejected and I'm now thinking of POPLA appeal.

a few points to mention:
the car park is my Gym's car park, I've complained directly to them in which the manager of the gym has provided me proof of when I was using the facilities (same date & time the notice has been issued) and has said send this to Euro car parks and they should remove the charge. unfortunately I complained to my gym AFTER appealing which may have hindered me.

I sent the proof along with an email from the manager but Euro car parks refused. can any of the proof/emails be used in my POPLA appeal?

I only really have the two points (below) to appeal for POPLA so not sure how successful its going to be.
1. signage
2. No land owners rights

any extra points or information would be appreciated.

The landowner/landowner agent (gym) has stated they want the charge dropped, so of course you should use that.
On the downside, this means the driver will most likely have been identified so non PoFA compliant NTK can't be used if that was the case.

Signage, not the landowner, no standing to issue charges in their own name, no contract with the landowner should all be used.
