final demand from moriarty law

have just received a 'final demand before court proceedings ' letter fom moriarty law saying if we don t reply and pay within 16 days the debt goes up and county court etc , the debt was from brighthouse was interest that was left to pay but i fell into difficulty tryin to keep up with the weekly payments , whats my best course of action please anyone as i have 5 children and im struggling already this xmas an dont even no where id find 500 pound in one go! worried

that was my plan but i was worried they wouldt not accept or would want a huge weekly amount which again id struggle with , i want to pay it obviously but im in the situation because of big weekly payments and would struggle again , do they have to accept what i offer or will they dictate terms do you think?0

Is it just xmas struggling with or all year - can post on debt free wannabe board.
The letter you got does it say anything like Letter of Claim or Letter before Claim or Pre-Action. Does it include a budget form or give options to pay in installments
As you state you owe it and it is affordability that is the issue, it is really coming to an agreement that is affordable for you. Don't just ignore it, seek free debt advice if struggling.0 -

They will probably try to get a high amount ut of you, but don't agree to anything unaffordable. Make an offer you know you can afford, don't feel you have to offer more because they may refuse. If they want to go through a budget with you you can refuse and state what you have offered is affordable. If they are unwilling to do that, request some breathing space and create a budget with CAB, stepchange, national debt line, etc and provide that to them.0 -

They will ask you for incomings and outgoings and work something out based on that0

Don't phone them if is pre action protocol paperwork and forms. Just complete the form including the part for instalments. Make sure your offer is affordable.I work within the voluntary sector, supporting vulnerable people to rebuild their lives.

Then yes that's what they'll use.
It doesn't make you exempt from paying them0
