Surely if i went to court for that money they'll just say no deed of trust etc so its evenly split.
Only you are making that assumption. Do you have proof of deposit funding and evidence of it leaving your account around the time of purchase.
Don't lose energy. Keep sight of what you put in and what you will be taking out. Don't worry about court hearings, it will never come to that, your ex knows exactly how the original purchase was funded.
And don't forget that you are both 100% liable for the mortgage payments, not some 50/50 arrangement. She can't stop paying just because she moved out.Signature on holiday for two weeks0 -

True, but she is also entitled to her share of the rent the lodger is paying to live in her property.0 -
If I were you, I would just sell the flat and cut your losses. Take this as a lesson learnt and move on.
If you try rent it out and continue paying the mortgage like that I fear you will dig a deeper hole.

The lodger pays her half of the mortgage. She hasn't paid anything for near to 3 months.
I will sell then and maybe hope I can get her to be reasonable and get my money back. But will try ensure she helps market the property as that's her decision.

Is lodger paying towards bills in the rent? If so you need to be cutting what she gets to ensure you are not losing out on the 50% Offer to work with her to sell for a price that works but the 15:10 split remains in place, otherwise suggest you will hold out for a VERY good priceThe lodger pays her half of the mortgage.
