Template letter VRN byelaw 14

I recently received a "notice to owner" for a railway carpark penalty notice. The driver had entered the incorrect VRN into the machine (one character different from the actual VRN).

Is it worth modifying the original template letter from the newbie thread indicating the VRN entered by the driver to prove that payment was made on the day?

Also I am a bit confused on whether denied appeals go to POPLA on a Byelaw Penalty.

    Which parking firm? They are not allowed under their CoP to issue a PCN for one digit error.

    I have read that IAS have that in their CoP but BPA hasn't stated anything about incorrect VRNs.

    Oh yes they have. Read the POPLA annual report 2018 about SIMPLE KEYING ERRORS.

  • Interesting read my issue is :
    SABA website states:
    "Please note that Penalty Notices received at a Rail Car Park cannot be appealed via POPLA."

    The report also states:
    "The British Parking Association suggested that its operators considered cancelling Parking Charge Notices where it was clear that the parking charge had been caused by a simple keying error." (my emphasis)

    I guess I can only appeal and see what happens next.

    Nope, I'd be complaining without saying who was driving, to SABA that this appears to fall within the single digit 'simple keying error' or keypad malfunction that the BPA said in a recent instruction to all parking firms, should cause them to consider cancelling a PCN. Also, a keying error caused either by the driver or faulty/sticky keys, is not a byelaws breach, so ask them to show exactly which byelaw they reckon was breached by a fault and failure in their own system to record a digit.

    Attach proof of paying without saying who was driving & encourage them to cancel it.

    No replying too soon!

    The ENTIRE POINT is to string it out to 6 months, so wait till the last day they give to reply, then again when they reply telling you to get lost and deal with ZZPS, wait...then slowly send the same stuff to ZZPS.

    The time will fly while you have fun with this! Soon it will be timed out.

    You get no POPLA stage and they will knock you back, but it WILL time out.

  • Sorry I used speak informally instead of correspond.

    The letter I received is from ZZPS naming their client as SABA, I assume I would have to appeal to ZZPS and not SABA, as ZZPS could pursue action if they are not aware of the appeal made to SABA.

    Neither ZZPS nor SABA can pursue any action. At all, ever, in relation to byelaws.
