Who is liable main or sub contractor?

Hi,
So I'm a subcontractor, registered c.i.s and self employed.
I'm working for a company who as a main contractor, should be stopping 20% of my earning by law. Yet they dont. They choose to pay me gross and I dont qualify for gross pay 0%.
When it comes down to the crunch and this money gets declared in my self assessment. Who is liable for the fees in a court of law. Me or the main contractor..
I only ask because some lads are doing 80k a year, with out deductions.. so when the Bill's come. Who do the courts come too. The main or subcontractors?
Also some of the lads believe they are employed. . Yet they are getting no deductions either.. they have no utrs and dont know what paye is!?
