I think on its own, as it is not part of the argument against the £60.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi C -Mad,
Hope you are well. Filed my WS today and to my surprise , when I got home , found the WS from BW. Written by a paralegal that refers me to both he and she throughout. Clearly some underpaid paralegal who gives a toss about anything legal. Lol.
I was glad that my thoughts on the payment by card has proven to be correct and that another
tarriff didn't actually exist at that time. So hopefully the frustration of contract will work on this.
Have been going through the WS and the added £60 is being referred to as a debt collection charge/cost of recovery. I guess this is just another name for it and will still fall under the Abuse of Process Defence and an attempt at double recovery.
Mentions that BPA COP mentions that debt recovery cost could be added upto £70.
And CHAPLAIR VS KUMARI 2015.
MAKES reference to Beavis but more towards the actual £100 charge.
Any thoughts on this will be helpful0 -

I pointed out that his client had not filed/served it, but no worries, I was familiar with the case and it was an irrelevant case about lease terms that were set out clearly (a signed agreement) and not comparable with a parking charge case...
He then didn't bother with it! Sussed!
All you need to do is search the forum for Chaplair or Kumari to see this chewed over and spat out before, in loads of cases.
Read the quote I've added from DJ Grand at Soton, to post #14 of the abuse of process thread. He called out the BPA CoP argument...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
