PLEASE HELP I’m so confused! :(

Guys I’m so sorry I have read the newbie post but it’s all so confusing, so many links and different scenarios, I think I feel I’m too far in to start all over again and right now I feel like paying my fine and being done :(

PCN May 2019.

Parked in car park and paid via the parking app for the wrong car park (one across the road)

Received £60 fine

Appealed it

Lost (but never received the letter) -£100 fine and too late to appeal with popla as advised by CAB.

£160 fine now with bw legal

Paid £1.80 (what I felt I should owe! Oops)

Charge now £158.20

6 months and I’m so sick of letters and calls I just have no idea what to do next.

Please no mean replies, I get that these threads are frustrating but am I fighting a losing battle here!

You are at the debt collectors stage which means all you can do is wait. See what there next move is, they might send a letter before claim or they might not.

I note they have added on spurious amounts despite being told in court they can't do this.

Don't respond to their stupid debt collectors they actually have no powers to do anything than print letters and buy stamps.

the only way to end this early is by a owner/landlord cancellation.

NCP is the ppc. Where is this car park?
  • Oxfordshire. 4 shops on site I think.
I just made a genuine mistake paid for the wrong car park (with proof)
    £160 is absolutely insane.

Pester the shops to see if they will cancel it. If it's local go in and kick up a fuss.
  • It is local - if it’s at a stage that they can do that I will try that thank you. :(

It currently is. If the shops have engaged NCP to manage parking they call the shots. If they haven't then they might know who has for example a management company.

    £160 is absolutely insane.

The Supreme Court has stated that £100 is reasonable, that extra £60 is a scam, read this

    https://forums.moneysavingexpert.com/discussion/6014081/abuse-of-process-district-judge-tells-bwlegal

It is not a fine, it is an invoice from an ex- clamper for damages for the harm they allege they suffered when you did what you did. We call it a scam. Pay them not one penny unless a judge so orders it.

Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, it can cause the scammer extra costs and work.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
