CCJ from Civil Enforcement advise please

So found out a week ago that i have a CCJ from cvil enforcement from 2018 for parking in a GP practice.
However, my friend was a patient at the practice at the time receiving treatment there. We have managed to obtain invoices of the appointment and also a letter stating that my friend was not made aware of having to put the vehicle registration number plate in to the computer. The letter was stamped and signed by a staff member from the practice.
We can not remember who the driver of the vehicle was at the time as this was over a year ago.
I do not remember having received a county court summons letter
I want to apply for a set aside on the basis that the vehicle was parked there lawfully and that the practice have stamped and signed the letter stating that my friend was not made aware of parking control and having to put the vehicle reg into the computer.
can anyone advise me please?

I'm in a very similar boat to you, I'll tell you now before someone else comes along the best thing you can do is read the 'sticky' threads at the top of the forum for advice on what to do. Click on my profile and read my threads as a start if that's easier.
Are you the registered keeper, have you had any correspondence from CEL and what happened that you discovered it?0 -
there would be no summons letter, its not a criminal offence , its a civil matter
the first questions you should be asking yourself is why none of the paperwork arrived at your door, because a lot of it would have been sent out by CEL and then by the CCBC in Northampton
check the V5C has the correct name and address on it, if not, get it done at the DVLA asap, ditto with a driving licence too, up to £1000 fine from the DVLA for each one
the point is you should have received numerous letters, and didnt , so that reason is paramount to any set aside, because a judge will need to know how this happened and why no paperwork arrived from anyone
if it is set aside then you can argue about the problems at the practice and vehicle registration etc, but that is for the defence of the pcn
the set aside is about the failure of papers to the correct address, not the pcn or practice problems
read about the 6 point set aside and the £255 cost to do so too0 -
No, you want to apply for a set aside due to not receiving the claim form.I want to apply for a set aside on the basis that the vehicle was parked there lawfully and that the practice have stamped and signed the letter stating that my friend was not made aware of parking control and having to put the vehicle reg into the computer.
This is not about the defence, that's separate and comes later.
How to set aside a CCJ is already covered in post #2 of the NEWBIES thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
