Apcoa Refused Appeal Late Charge Notice

Hi There,

I have received 7 parking charge notices for alleged offences at my local train station, Solihull. I thought it was free to rail users! I did not receive any notices on my vehicle and the first letter was 13 weeks after the alleged offence. Only 1 notice was issued within 14 days. They have refused all 7 appeals. Is it worth my going to POPLA? They told me on the phone they had 7 months to issue a ticket in the post and are not bound by the Freedoms Act of 14 days to issue notice.

Can anyone advise & is there a POPLA template for this.

    As this is APCOA, appeal every one to POPLA. Do you have 7 separate POPLA codes?

    Do a forum search on keywords APCOA POPLA station and find a recent APCOA POPLA appeal, particularly where APCOA have thrown their cards in and use that. APCOA almost always withdraw when they are faced with a decent POPLA appeal.

Click on the 'Advanced Search' button and on the following page place your keyword(s) in the 'Search By Keyword(s)' and make sure the 'Show Results As' button (at the foot of the window) is changed from 'Threads' to 'Posts'.

    I remember a similar APCOA case on here for Victoria Station , Manchester , a couple of years ago


    as mentioned above, find an APCOA railway station popla appeal and plagiarise it , should be a few , but not many


    also look at METROLINK ones on here because similar issues arise for the POPLA appeal, even though they are ANCHOR (Care Parking)

    Did you follow my advice (above) on how to conduct your search using keywords?

    If those keywords didn't bring up anything, the try APCOA POPLA Luton and APCOA POPLA BHX. Both of them will be airport cases, but the POPLA appeals will cover similar issues to railway parking charges.

    You can't fail to beat APCOA 7 times in a row - impossible. :)

  • Cheers, seen both of those, but they aren't out of time cases / took too long to notify. I have already admitted to being the driver & parking there & should have paid (& offered to pay them), all I have to appeal against is the amount of time it took to notify me - 13 weeks initially (first notice on 15th October & offence on 31st July), the rest came at once, but doesn;t matter as it took so long for the first one to hit I thought it was free all that time!

    What do you think? Worth a POPLA appeal??

    if you are an admitted driver the length of time to deliver has gone out of the window with POFA etc , which is why 7 months was mentioned

    a shame you did not appeal as keeper as POFA doesnt apply and a slam dunk , especially on timescales, but not as driver

    a popla appeal would have to rely on no landowner authority , poor signage and any other technicalities

    my advice above still stands, find the metrolink or vic station popla appeals , remove the pofa elements and use those leftover arguments as I mentioned above

    Don't tell us you threw away the winning position as keeper in all seven? You didn't say you were driving all 7 times in your appeals, surely not?

    APCOA are the easiest to beat at POPLA, you only had to copy another thread and NOT say who was driving. They are so simple to see off.
