unmarked bay parking for 3 minutes exactly fine.
Hi
guys , I have had a new fine from Euro parking Services for a car parking for 3 minutes in a car park not parked in correctly within the markings of the bay or space. There was a space at the end of the car park that didn't block anyone in. The Car was parked there for three minutes and got a CCTV parking ticker for that. Now I have a letter from their solicitors "letter before claim" Their solicitors are Gladstones Solicitors. amount of £160..ridiculous people! any advice. Thanks

    You don't need any advice.

Just follow the guidance given in your other thread - i.e. start by reading the NEWBIES thread.

Come back with specific questions if you have any.
  • Thanks Keith. I was wondering whether there was one for specifically parking for 3 minutes . I'm sure there must be a grace period ?

    "CCTV parking ticket"?

I think you mean an ANPR ticket, not CCTV.

ANPR just detects number plates on arrival and departure. It cannot see where a vehicle was parked - in a bay or not.

Was there a windscreen ticket left on the car at the time?

    One what?

You are passed the appealing stage.

Read post #4 of the NEWBIES thread to discover how to deal with debt collectors letters.

Read post #2 of the NEWBIES thread if you have actually received a Letter of Claim.

Yep it was ANPR and no windscreen ticket was left. But it clearly shows the vehicle parked in an area where there were no parking bays. But not clear from anywhere that you couldn't park there. They have about 5 parking bays and the vehicle was parked were no bays just for 3 minutes. they have sent me photographic evidence of where the car was parked - It looks like a camera of some sort that is attached on top of the retailers (Tesco)

Read the IPC CoP regarding grace periods and forbidding signage

Too late to appeal , but any appeal would be rejected anyway , so you are where you are , awaiting possible Loc or an MCOL Court claim from the CCBC in Northampton

    It's not a fine , it's an invoice , it's not CCTV , it's Anpr cameras ,

Read post #4 of the newbies thread about debt collectors

Normally we would advise you to not reveal the driver's Identity , but this thread shows that you haven't learned that lesson , yet , despite your court thread with NCP on here already , where the BPA Cop applies instead

A crim would be told to say , no comment
  • Hi,

I just checked the letter from Euro parking services and it is a CCTV - contravention was detected and recorded by CCTV.
    thanks for the other advice.

How does a grace period work with a 'not parked in correctly within the markings of the bay or space' parking charge?

Read CEC16's thread now (NO LINK) to understand why they cannot claim that sum.

It is not a fine, it is an invoice from an ex- clamper for damages for the harm they allege they suffered when you did what you did. We call it a scam. Pay them not one penny unless a judge so orders it.

Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, it can cause the scammer extra costs and work.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
