CPM PCN X 2 advice,

Hello all,

Firstly I must say what a wonderful thing admin and regular advice posters are doing here. I wish I had discovered it sooner. :mad:

I’m looking for a quick bit of advice on my current situation. I’ve been issued with 2 PCNs from CPM. A private parking area within our apartment block. Myself and my housemate share the space with 2 cars and the permit supplied is often changing hands and cars, in these instances the permit in question was on the seat and visible. This however was not satisfactory and I have been issued with 2 PCNs, for 2 days one after the other for not displaying a valid permit. The initial PCN was issued via a letter in the post, the following by a ticket in the window and a follow up formal demand in the post.

Before I had discovered this wonderful source of cases and information which I’m doing my best to trawl through, I innocently thought I could protest them on the grounds of them being unfair. That the space allocated to our apartment was rightfully ours to park in, permit or not. I had previously incurred a PCN from the same company and stupidly paid it straight away.

In my protest (which I do not have a copy of to reference having submitted) I fear I may have admitted to such wrongdoings and I fear I may have thwarted a good chance at any case of fighting or appealing further.

With the fact that I may be “on their system” so to speak, having paid them off previously would this hurt my chances of fighting it these times round? Is there any rectifying the damages I have done with my previous appeal?

Any help or advice at all would be greatly appreciated!

    No.
    Is there any rectifying the damages I have done with my previous appeal?
    You have not damaged anything, as no appeal would work v UKCPM and when it comes to a court defence you will be defending as driver anyway, due to the main point of defence you have (primacy of contract). So your appeal was OK.

    Come back when you get the Gladstones Court claim.

    My first letter from Gladstone’s arrived today, providing me with the opportunity to contact their client and make full payment of 160£. No reference to which PCN case they’ve decided upon. Are there any actions necessary at this time?

    Also on a side note, there is a likely chance I will be leaving the UK with a new work opportunity later this year and not returning. Any idea how this will effect my current case or if it could possibly work to my advantage?

    When you move/have moved, send a Data Rectification Notice to the DPO of the PPC advising them of your new address for service.

    hat does your lease/AST say about parking? Does it mention the need to display a permit? If not then it may take primacy over the self serving TnC of the scammer, and interfere with your lawful right to “quiet enjoyment” of your property, possible an offence under The Landlord and Tenants Acts.

    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation. 

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
