County Court Business Centre Claim Form

Hello,

I've ignored and binned all of PE's letters (I now realise this was a mistake! :( ) and now have a Claim Form from the County Court Business Centre. They are claiming £182.48 + a court fee of £25.00 + a legal representative's costs of £50.00. So a total of £257.48. The 'charge' is for being 24 minutes over the 3 hour 'free' parking period.

Does anyone know if this is now a 'done deal' or can I still fight this case? If so, what would be the best form of defence?

TIA for any help you can give or point me towards.

*Edited to add: Date of claim form is 29th October 2019

    Those totals don't look like a ParkingEye claim. Theirs are almost always £175.

    Are you sure the claimant is ParkingEye Ltd of Chorley?

  • It is definitely not a 'done deal' and it is certainly defendable. I would advise reading the Newbies thread over a few times and the links in there to get yourself more familiar with the process and gain more of an understanding of the process.

    You need to ensure you file the Acknowledgement of Service (AoS), which somebody will come along shortly to advise you of the timescales.

    A few questions that need answering for people to give better advice;

    1: Has the driver been identified at all? I am guessing no if you have ignored and binned all the letters.

    2: On what type of land does it relate to? Retail park, airport, train station, hospital etc.

    I am currently fighting one of these myself and started off with no knowledge of anything to do with private parking companies, but I know feel pretty confident about defending it and understand everything a whole lot more. This forum is a really great place but remember you must be willing to put in the effort and work yourself - so start by reading the Newbies thread like a bible until it sets in!

    My mistake - This is Civil Enforcement Limited of Liverpool.
