Should I pay this parking eye fine?

Hi all,

I received a letter from Parking Eye/ Debt Recovery Plus today, chasing a payment of £140. It says the parking charge date is 22/09/2017 and they are still chasing it. Driver parked in an Asda carpark with 'no valid ticket'. the driver may have forgotten to get a ticket, or the machine was broken.. it was a long time ago! Should I pay this fine? I have always been told to not bother paying parking eye fines but after doing a little research I read that they have started taking people to court. And as the fine is quite high, and they have been after it for a while, maybe they will take me to court?

Any help would be great. thanks!

To answer your query - now DRP are involved - NO!

Once PE hand over a claim to debt collectors they've all but given up on it, and (to date), they do not pursue the claim themselves any longer.

But if you were on the day (or regular) an ASDA customer, the manager can cancel this from his desk - he has a direct link from his computer to the PE database. Take receipts, cc/bank statements to prove your patronage.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You should not pay this fine as you haven't been given a fine.
You should however, be looking at challenging the parking charge notice, have you contacted ASDA?

    Perfect thankyou !
  • Also, please remove any idea of who was driving in your opening post. You are the keeper of the vehicle, not necessarily the driver. Please amend your post to say 'the driver may have forgotten to get a ticket...' etc.

Similarly, when you contact Asda to appeal and ask them to cancel the parking change notice, ensure you do not identify the driver.

If it does go further and it does get taken to court, they have to rely on the POFA to hold you liable as the keeper if they cannot identify the driver. The POFA has very strict conditions they must adhere to and PPC's usually do not adhere to these, giving you an extra angle of defence!

Thanks Le Kirk, the forum has been very helpful for me and I figured it is the best way to give something back.

    Absolutely.

Great to have you on board Chucky, it's a great way to return pain to the PPC ..... and with interest!
