Claiming Back consent to let charge

Hi!


I was renting out a flat with consent to let and lender (Halifax) charged me for that.
Then tenants moved out, I decided to sell the flat (unsuccessfully) for long period of time it was on market. I notified the city council about unoccupied flat but forgotten to notify lender which continued charging me...



I have council tax bills confirming that certain amount of time the flat was unoccupied.


My question is can I claim back the money lender charged me for the period when the flat was unoccupied?

    Unfortunately it's the not the lenders issue that you couldn't let the property. Retrospectively claiming is not an available option.

  • They still gave you consent to let. Just cause you didn't use it doesn't mean they didn't give you consent.
    They upheld their part of the deal

    I bet you'll find agreed to annual auto-renewal of the CtL until explicitly cancelled, if you read the Ts & Cs.

    You had CtL, you could have let it. The fact you decided not to (or couldn't) isn't the lender's issue.
