Hi
Since the cold months have arrived I've noticed how hard it is to heat my apartment. I moved in on July with a 12 month contract and wondering about the possibility I could get out before then.
I base this on what I initially thought was a pretty good Energy Performance Certificate Rating (EPC), whereby in reality I cant see how the grade was achieved. The heating is on flat out and there are draughts coming from God knows where.
I feel let down that part of the reason I took the flat was down to this energy efficiency value which was on the C scale.
The rating is miles out and as this is one of 18 other flats in the same block, it may be that the surveyor assumed rather than actually surveyed the property. Does anyone think this is a viable 'get out' to approach the letting agency with?

What specifically is incorrect about the EPC?0

I assume you've checked those things on the assessment that are verifiable and you've found they check-out, or you'd have told us.
The landlord provided an EPC with a rating of C which is above the minimum acceptable for rentals now, so unless you have knowledge that it was obtained fraudulently, he's in the clear.
Mistakes may have been made, but unless you can identify them and show they are of significant magnitude,supposition isn't grounds to allow an early surrender of the tenancy.0 -

An EPC isn't very sophisticated.
For example, it takes no account of draughts.
And if, for example, you have an under-powered boiler that struggles to keep the flat warm - that won't impact the EPC either.0
