Small claims court hearing

Admin I hope this post is ok.
I have started proceedings in the small claims court for a horse riding holiday which I believe I was mis sold (basically booked a holiday described as riding through Sherwood forest and staying in a 4* hotel, which was actually a riding holiday in which we never entered Sherwood forest nor any other forest and instead rode along roads and round farmers fields, and were in a 3* hotel) we have a court hearing allocated in January but today received notification of a directions hearing in November. I've phoned the court and been told that this hearing is being held as the defendant wants the location changed to her local court in Cheshire (currently it is in Essex ) can she seriously request this change? We've already travelled several hundred miles for a holiday which was not as described, she has refused arbitration at all stages, - she is prepared to travel to this hearing but not the proper hearing in January. This just seems rediculous and completely unfair.

    The defendant can ask. It doesn't mean they will get it though.
  • I thought that if it was a consumer -v- business claim the consumer could opt for their nearest court - but I could be mistaken.


    I'd oppose the move on the grounds that the defendant is a business and they should come to you.

    That is correct. It sounds as though the business has asked for it to be moved closer to them. A well worded opposition to it should see this request thrown out.
