    Yes, that's better.

    Last question before sending;

On the particulars of claim they have added interest onto the PCN, see below:

"Together with statutory interest of £10.74 pursuant to s69 of the County Courts Act 1984 at 8.00% per annum continuing at £0.04 per day"

Is their anything I can add to the defence draft to dispute this additional cost?

    Thanks

No because they can (charge interest at 8%).

Add in a paragraph that the CRA 2015 disallows the added £60 double cost as 'penal' and likely to be unfair.

I just posted links in another thread; info that you can use at WS/evidence stage.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you everyone for all the help provided.
    I really appreciated it.
now that the defence draft completed and sent, I know this is only the beginning , do you guys suggest
1-I write a letter to my MP?
2-I contact Gladstone solicitors with a letter as well?
3-SAR was filled over the net five days ago but, no reply. do I have to request again or send a complain letter.
4-do I have to start preparing the WS or just wait?
    thank you

    1) yes , providing the correct person is used due to the election

    2) no idea why you would write to gladrags

    3) your SAR gave 30 days , as standard , so wait patiently

    4) it's a good idea to do so whilst it's fresh in your mind

    5. Read the Portswood thread by CEC16 and prepare to use what you learn at WS stage. :)

Yep, NEWBIE sticky post # 2, scroll down until you see: -
WITNESS STATEMENT EXAMPLES - AN EASY STAGE - YOUR 'STORY' AND EVIDENCE

A WS is simple, it expands on your defence and tells the story from your point of view, and it is vital because it includes your evidence exhibits such as photos of obscured/tiny font signs, any relevant letters, permit/copy of your lease, copy of your authority to park, etc.
......... then follow the links. Another good way is to search the forum by using the name of the car park where you were ticketed and Witness Statement as your keyword(s) in the Advanced Search. Don't forget to change the radio button from Threads to Posts.

    Hello again everyone

I’m preparing my witness statement, I have received a court date so I would like to address some points and get some advice please.

1-on the first paragraph the judge has considered the case is suitable for mediation. Shall i just decline mediation as going to the end with hearing? Only had 7 days after receiving this order. 7 days Expired yesterday.

3-The parties are encouraged to try and settle the case by negotiation. If so, the court must be informed. Do I have to inform anyone before no mediation?

4-each party must deliver to the other party and the court office copies of all documents of which that party intends to rely at the hearing no later than the 14 days before hearing,

Is that means I’ve got to send the witness statement along with photographed evidence to both parties the claimant and the court? Is there any benefit in delaying it to the last minute or just send as soon as they’re ready with a witness statement?.

    Thanks 😊

All explained by Bargepole in the NEWBIES FAQ sticky, second post.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Show us your draft WS and read the threads by keypulse and Lego-9 for examples of WS and what else to submit with it at this stage.

Obviously no-one agrees to Mediation but bargepole's post linked in the NEWBIES thread under the 'KNOW WHAT HAPPENS WHEN' red heading, tells you this already.
