Ppi cmc

Hi I'm hoping someone can give some advice about cmc's.
Back in May my mum filled in an online form with a company called allansons for ppi. About a week or so later a woman claiming to be from a different company magnum claims called her informing her the company had gone bust and details had been passes onto them. My mum gave out her address over the phone and they sent her letters of authority in the post.
At this point she told me about it I thought it was dodgy and told her not to send them back. She didn't.
In late September she received a cheque from black horse for about £1500. She assumed it was just them sorting their own accounts.
Last week a month later she started getting txt messages from a company called HD law saying they'd secured a ppi refund from black horse and someone would call her to take their fee over the phone. We assumed it was the black horse cheque. I obviously told her to ignore until paperwork arrived in post and not to give them bank details over the phone. In the meantime she has been receiving threatening voicemails from the company.
She has now received an invoice saying she owes them almost £600 for a refund of £2500. Which clearly is not that money from black horse. She is going to contact black horse to clarify any claim details.
Is she liable to pay this company when she had not heard of them until the txt message last week, and she did not sign the letter of authority magnum claims sent her as she still has it in her house?

    Oh, the murky world of Allansons. Unfortunately your mum must have contacted Allansons just as they were being closed down. If memory serves me right, they would not even have been authorised to carry out PPI claims at the time, so they have probably just sold the lead across to these others.
    See what Black Horse say, as they should be able to confirm who they were dealing with and the amount of the claim. Then speak to the CMC who will not be able to charge more than 24% Including VAT of any claim amount as this was post FCA regulation. Complain to the company and then FOS if needed if they push for more
    HD Law - hmm....they don't fill you with confidence with a statement like this on their website "Welcome to HD Law. Have you been mis-sold a financial product that you wasn't aware of?"

    It could be the Black Horse refund as, if she had any outstanding unpaid debt with them, Banks were allowed to offset this against the PPI redress. Unfortunately, if this is the case, the Claim Company will charge a fee based on the total amount even if some of it was offset.

    She should have received a redress letter from the Bank explaining the refund and providing a breakdown of the payment. If she doesn't have this, she can request another from the Bank, she should also find out if the Bank refunded because of a complaint received from the claim company.

    If your mother is adamant that she didn't send the Claim Company any Letters Of Authority, then she can complain to the company that they have acted without her signed permission and that they cannot therefore charge a fee. This complaint can then be referred to the Ombudsman if she is not happy with the company's response..
  • So an update. Mum contacted black horse who confirmed it is the same refund the outstanding amount is a former partners share of the refund but no one knows where he is. They agreed to send her the refund breakdown and a copy of their paperwork from HD law. She should have left it at that for now. However after receiving more txts and voicemails threatening legal action she called them. Told them the situation and asked for copies of the agreement she had signed with them be sent to her as she had not heard of them they reluctantly agreed after telling her the longer she took to pay the more chance of court proceedings. They also confirmed that they had taken over for? Allansons and magnum.
    A short while later someone else from hd law called told her they'd been in contact with black horse who had confirmed her story so they were reducing the fees based on her £1500 refund. She told them she didn't want to pay until she'd discussed it with family and looked at the paperwork and apparently she was upset, but after much badgering she paid them by giving her bank card details over the phone!
    After coming off the phone they emailed her a payment receipt and the documents of authority, which very clearly are not my mum's signature. One of the documents even has hd laws name on signed in April when they admitted they had taken over from the previous companies later.
    Is there anything we can do about this now she's paid? She's now also terrified the cowboys will make purchases as she gave them her payment details over the phone.

    That sounds like the end of it, fortunately.

    While they certainly charged expensively for doing very little, they certainly won't be using her Bank details to make fraudulent "purchases". :eek:
