Will

Hope someone can help. Have discovered a Will six years after death. Probate granted on the basis of no will. Getting hold of the will is the problem at present, It is with a Deeds company who have confirmed a family member is a beneficiary and the names of the two executors. The Will was written in 2006. The two executors names are not familiar to the family. The deeds company will only deal with the executors who they have written to but no reply. After 13 years people move or die. Any suggestions on getting hold of the will or the address of the executors for us to do our own search. Thanks for any help.

    i'd suggest a chat with a solicitor is your best course of action.

    How did you 'discover' the will? The question isn't mere curiosity - I'm wondering if there would be any way to use that source of information further.

  • If the executors cannot be traced, then next in line to administer the estate would be a residual beneficiary. If the person who has lost out is not named as a residuary beneficiary and none of the residuary beneficiaries are prepared to administer the estate, then that person can do it.

    Problem is the deed company won’t do that until they are sure the executors cannot be traced and they have failed to get a residuary beneficiary to act.

    Once over those hurdles the next step I’d to get the letters of administration revoked by the courts, and even if you manage to do this there is no guarantee that the losing beneficiary is going to be able to recover their inheritance, as the following link explains.

  • Wrote to dozens of solicitor in the area. Three years later it came good. Just need to get hold of it.
