PPI cancellation fee & CCJ

So, my HR dept called me on Monday to say £100 is being taken from my wages because of the ccj I have. I was absolutely shocked as I owe nothing to anyone and always pay on time.
From further investigation, I’ve found it’s a company called Your Money Claim.
I filled out an application with them in 2015 as I thought I may be due £ back from when I took out my mortgage. I gave the name of the mortgage company etc and sent it off. They then requested full details of my financial advisor. I couldn’t remember their name and didn’t have the paperwork any longer (house sold in 2010 and renting thereafter due to marital break up) so I decided not to proceed as I can’t give what I haven’t got.
I moved house in sept 2015 so all paperwork went to the old address. I’m trying to get the judgment set aside but even that will cost me £225.
YMC are saying I owe them £918! That’s a cancellation fee of £748 plus court fees. They didn’t actually do anything!!
Can anyone tell me where I stand please?

If this is the case, I doubt you have a case for having the resultant CCJ set aside just because you moved away...
However, CMCs are now regulated so any complaint you make to the Claim Firm can be adjudicated by the Ombudsman...0 -
I stupidly assumed that they were on a no win no fee basis so deciding not to pursue it wasn't an issue as they hadn't even done anything re: ppi claim.
I didnt tell them I moved as I wasnt aware of the cancellation fee thing.
I just cant believe they can charge so much for doing nothing!
Thanks anyway, I'll be writing to them to complain and then on to the ombudsman if I get no joy. Nothing to lose I guess! ��0 -

If you can demonstrate that the court claim was sent to a previous address, you have a good chance of getting the court to set aside the judgment. In the first instance you should write to the CMC explaining why you didn't receive the claim and ask them to agree to set aside. If they refuse then you can apply to the court yourself. If successful it puts the claim back to the point that you first received it, giving you the chance to defend.
The Ombudsman will not touch a complaint that is the subject of a court ruling so you need to concentrate your efforts on the court.0
