Uncle passed away Intestate

so my wifes uncle passed away a couple of weeks ago with no will or informal wishes of what was to be done with his estate
He had only one living direct relative, a brother, who survives him and this brother has two daughters .
the deceased uncle also had a sister ( my wifes mother) who died in 1972 .

it was my wifes understanding that because of Intestate law, that the uncles estate be shared out equally between his surviving brother and the deceased sisters offspring ( my wife) is this correct?
its just my wife and the surviving brothers daughter went to the bank to arrange to close uncles accounts and the bank official said that this wasnt the case and the surviving brother is the sole beneficiary.

can anyone clarify
