Beneficial Loan PPI Claim Not Up Held

Hi All,

I recently had a Beneficial Bank PLC loan from 1996 PPI claim not up held. I’m waiting for the letter confirming this. The documents I sent them was a loan agreement form, which shows the PPI cost as a separate amount and the monthly payment for that.

The claim wasn’t upheld because they require statements that show the PPI was paid. I had a payment book for the loan and as far as I remember, I didn’t receive any statements for the loan that showed the PPI payments.

Is a loan agreement that has all the relevant details plus is also a legally binding contract, not enough to say that I had PPI and paid for it. The PPI payment was part of the monthly loan payment.

Would anyone be able to offer any advise?

Thank you

Andrew.

bank statements to show you paid the loan in full?

You could have cancelled the PPI before the loan payments started.

  • When I phoned the HSBC they said that but I couldn’t of done because the PPI payment was included in the monthly loan payment.

How did you pay this loan?
And yes, you could have done that.

So you paid it how? In cash? In person in a bank? Someone came to your door?

Did you pay by cash or cheque.
If cheque, you may be able to request statements from the bank you paid from to prove this. If you didn't, you have no way to prove this without the book you paid in to.
You can forward your complaint to the FOS even if you don't have proof you paid the entire loan they may decide the balance of probabilities lies with you, they may not. There is nothing else you can do.

  • I have also got an Experian Credit File report from 2003 that shows the start date and the settled date of the loan. It also shows the monthly payment and how many months it was over.
  • I sent a copy of it to HSBC.
