Mcdonalds refusing to pay unused holiday, 0 communication from their side

At first they told me it starts in march but now they claim its january. I got employed nearly 2 years ago so...
If the holiday year started in March, and you left in August, you only accrued 5 months holiday. Not a full year's holiday.
If your annual entitlement was 28 days, from March-August, you would only have accrued 12 days. If you had taken 2 weeks in June you wouldn't have very much holiday left.0 -
Sorry to tell you this but there's a fair chance you'll owe them holiday. You don't get your entire years allowance on day one, it's earned throughout the year so you've only accrued holiday for the period you've worked.
So instead of a payment expect a bill.0 -
OP, Getmoreforless's calculation is correct, if the holiday year starts in January and you are entitled to the statutory minimum holiday, you have probably used all of your holiday entitlement.
There would have been 6 bank hoidays in the period Jan-Aug, so (unless you worked any of the bank golidays) you will have used 4.1 weeks holiday, and you only had 3.74, so you would owe them 2.2 days pay.
If you worked 2 bank holidays you owe them 0.1 days pay and of you worked mroe than 2 bank holidays they may owe you the extra days.
If the holiday year starts in March as you originally thought, than the calculation would be 5.6x6/12 = 2.8 weeks, in which case of you have taken 2 weeks holiday in the current year plus 5 bank holidays (unless you worked any of them)so you have uesd 3 weeks holiday and would owe them 2 days pay.
If you worled 2 bank holidays then ypu were paid theright amount and they owe you nothing, and you owe them nothing. If you worked more than 2 bank holidays then yes, they owe you for the additional days.
This assumes that they give the statutory minimum holiday which is 5.6 weeks (28 days) including bank holidays.
if you thin kthese calcualtions are wrong, or that you did work enough bank holiday that they owe you days, then write (not e-mail) setting ot what you belive they owe you, how you have worked it out, and give them a set period of time (e.g. 7 days) to address it.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0
