If the contract was formed then whether they can pull out without liability would depend on whether you were aware it was a mistake or should have been aware it was a mistake.

So a item normally £600 priced for £500 would (imo) be an enforceable contract but a £600 item priced for £60 wouldn't be.

However, I would also highlight their terms state order acceptance while you state you received order confirmation. So, have they actually accepted your order or just merely confirmed it?

how do you know its an obvious error? a 2nd hand guitar for £139.99 isnt an obvious error, especially since you dont know the make or model. it could be a yamaha pacifica in which case its over priced!

IANAL but imo a contract exists and the OP could sue for loss of bargain. a second hand guitar at that price is not an obvious misprice. read this.

It might be, depending on what we're talking about. Since the OP hasn't logged back in to clarify since a month ago we may never know.
