    You said he cant afford it.
    So there's no decision to be made, if you cant afford something you stop paying.
  • It sounds as if the property is only in your partner’s name rather than jointly being owned with the ex. If that’s the case why is she still living there? What legal right does she have to remain in the property?
  • She has lived there for the last 12 years including 4 years since my partner left. She doesn’t have a legal entitlement to stay but won’t leave either

    She won't leave unless she is forced, in her eyes its the family home and she probably knows there is no consequences of not paying rent as your partner is being emotionally blackmailed - won't want his kids to be homeless. This can be seen as he has offered money as an incentive to leave.

    You say it is a shared ownership property and she has not paid rent - is your partner paying the rent for the 70%?

    Is he concerned about the impact on his credit?
    If not, then paying the maintenance only and waiting for repossession may be the way to bring this to a head. (not ideal) She will either start paying or realise that she will need to move at some point.
    Could the children move in with him?
    Many years ago I left my ex and he stopped paying anything to do with the property (joint mortgage) my finances were important to me so ended up paying my own rent plus the mortgage (child was teenager and with me) only when looking to start legal proceedings to force sale did he somehow managed to come up with a mortgage in his own name to buy me out (I am guessing it was one of the "lie to buy" mortgages as he did not work)
  • As this is his place, both of you can move in there. Then see how long she lasts.

    Would the ex count as a tenant with your partner as the landlord?
