debt management company not doing job what should i do

my sil employed a dmc to help her with debt think she was misold this help in the first place but suppose when you panic if it sounds like the answer you go for it can we do anything with that???

anyhow cos they not doing the job ccj is now turning into a claim on the house didnt have the ccj before the dmc were involved

what can she do have tried answering silver through a pm and tried putting more details twice now but will only let me do a short post so will add more bit by bit sorry

any advice greatly appreciated

    thanks clapton any other help anyone with regards can she get the 5709 back that she paid to them upfront as part of remortgage deal etc

    I think she should send a letter to the DM company, stating that she feels she has been mis sold there services, and that she will be contacting trading standards, as the so called professional advise has led to the situation she is in.
    She should say to avoid this she wants refunding, as what she has paid for hasnt been supplied.

    This may or may not work, but the best thing to do is move away from these idiots to one of the free debt charities, and also to visit the CAB, with any literature from the DMC, so that together you will be able to find a legal route to reclaiming this money, if requesting it doesnt work (it is a long shot)

  • If she has any standing orders or direct debits setup to this company, cancel them immediately. Then get straight on the phone to the CCCS. They are a registered charity and won't charge a penny for their services! :)

    I would definitely agree to her contacting one of the free companies straight away - she may well be able to halt the damage being done so far byt he dodgy company if she does?

    As regards to the money already paid, the letter outlined above sounds great and she could also contact the CAB for further advice on this?

    the mortgage company that passed sil on to them might be getting a similar letter!!!!

    stupid thing is that 11000 equity released has been sat there in the hands of the solicitor whilst the debts get worse the car is being close to being reclaimed etc etc and sil is struggling to put food on the table

    sent them a dpa request on friday and they even made her pay £10 for the privalege stating that they would be £10 down otherwise if it wasnt so serious it would be laughable

    on the paperwork from them and the website no details of any names qualifications etc etc but their second in charge who i spoke to on friday said he had been in debt management now for 5 whole years!!!! n i think i knew more about it learnt from on here i might add than he did!!!!!

    bloomin unbelievable!!!!

    how do they get away with it

    They get away with it because people panic when they are in debt.
    Point your SIL in the direction of this site so she can look for ways of cutting back to help the budget.
    BTW your thread has just given me an idea for a New year resolution. It is to point at least 1 person towards this site to try to keep people away from DMP companies (sorry meant to say professional companies but I choked on the words)

    Sorry I haven't posted here, wilf55, I have had something pretty serious going on off-board.

    I am looking into whether anyone has taken court action before for being mis-sold DMPs and IVAs. I think there is a definite undercurrent of this going on and it must be stopped. However, there are many people of the 'all mouth' variety claiming this and that regarding terms in consumer contracts. I've been trying to collect information but with what has been going on it is a little difficult.

    Long shot I know, but does there happen to be any bored crusading solicitor reading this? If so, PM me please!
