CCJ issued at old address

Hi there,

Have just been taking a look at my credit file due to needing to remortgage soon and have discovered a CCJ issued May 2018 for £354.

I moved out of the property this CCJ was issued to in December 2017, my previous property was a houseshare and I moved when I purchased my new flat. I don't know what this CCJ is for, I still know one of the guys who lives at my old address and he hasn't forwarded any post or asked me to collect anything that's arrived for me. I can't remember receiving any bills/debt collection letters whilst I was at the property towards the end of 2017, and I've had no other issues on my credit file!

I've called the court and I've been sent the application form to remove the judgement, I have proof that I've moved - end of tenancy agreement and flat completion details - but is there anything else I can do/provide that will help me apply for judgement for this to be set aside?

    moving without informing your creditor is unlikely to be seen by the court as grounds for a set aside.

    You should have informed all your creditors you moved.

    It's not their job to chase you down.
  • Not at all implying it was, and I absolutely believed I had. With lining up for a mortgage application for a good year before moving I was (I thought) aware of all creditors, which is why this is such a shock.

    I suppose I need to know the process of finding out more about this debt, I rang the court and they just sent me a N244 form.

    Does anyone have any advice of what would be my next step to find out further details?
  • Ask the court who the CCJ is from or look yourself on the registers
  • forget the N244 form.
    get back onto courts and find out WHO issued the CCJ

    then you can get ducks in order to apply for a setaside
  • I've been back in touch with the court and they've advised it's Civil Enforcement Limited. It's for eight minutes in a private car park.

    It was done via ANPR so no physical ticket and I've confirmed that the PCN was sent to the fleet company, not my personal address.
  • If it's for a parking fine then post on the car parking forum or request a mod to move this thread

    ok hopefully the post will get moved , or simply start a new post at https://forums.moneysavingexpert.com/forumdisplay.php?f=163 read thru a few pages or search "default CCJ"

    note a setaside will simply set the ccj aside , and you may have to fight the company in court

    the main question tho is what address did the fleet co give to the parking co , its obvious that they named you , but why no mail?

    Sorry but the above advice that you must advise all your creditors that you've moved is absolute nonsense.

    So I could go and sue one of my old friends using an old address and get an irrevocable default judgement against them because they didn't let me know they'd moved?

    Yours is a perfect example. Who is going to write to every private parking firm for every car park they've parked in for the last 6 years to let them know they've changed address in case they want to sue you?

    And before you say that they get this information from the DVLA. Yes they do, however the DVLA are slow to update this and the PPC also re-use this information in future without re-requesting it so it's not always up to date.

    Not receiving the paperwork because you've moved is easily considered grounds for set-aside. Although it's quite expensive I'm afraid.

    It's really not.
    Otherwise everyone and anyone would do it to get out of their debts.

    People would easily rather pay £255 than £1000 of debt.
